Terms of Service

These Terms govern your use of Apex — Junior GCSE ("Apex", "we", "us"), the website at apexacademy.co.ke and the learning application (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use Apex

Apex is a study companion for Key Stage 4 (GCSE-level) learners. If a learner is under 16, a parent or legal guardian must create and manage the account, and is responsible for the learner's use of the Service and for these Terms. By setting up an account for a child, you confirm you are their parent or guardian and consent to their use of the Service.

Apex offers a free Taster and three paid monthly plans. Prices are in US dollars (USD) and billed per month via PayPal.

We may change plan features or prices. Where prices change for an existing subscription, we will give reasonable notice, and the change will take effect at your next billing cycle. Your current features remain available for the period you have paid for.

6. Examiner marking service

Silver and Gold include marking of two exam papers per billing period by experienced examiners to exam-board standards, returned with written feedback. Gold papers receive priority turnaround (target within 48 hours; Bronze does not include marking). Marking is a professional assessment for learning; it is not a guarantee of any grade in a real examination, and marks are indicative. Submissions must be the learner's own work.

7. Parent monitoring

On Silver and Gold, a parent or guardian may link to a learner using a one-time code to view progress in a separate, private parent dashboard. This view is read-only and is deliberately not surfaced in the learner's study interface. Monitoring must be of your own child, with their awareness as appropriate to their age; do not use it to access another person's account without authority.

9. Intellectual property

All course content, text, questions, mark schemes, designs and branding are owned by or licensed to Apex. You receive a personal, non-transferable, non-exclusive licence to use the content for your own study while your plan is active. You may not copy, resell, publish or redistribute the content, except printing worksheets for personal use.

10. Educational disclaimer

Apex is an independent study aid and is not affiliated with or endorsed by AQA, Edexcel, OCR or any exam board. Specification references are indicative and should be checked against each board's current official specification. We do not guarantee any particular examination outcome.

11. Availability & changes

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free, and we may update, suspend or discontinue features. We will try to give notice of significant changes.

12. Limitation of liability

To the extent permitted by law, Apex is provided "as is". We are not liable for indirect or consequential loss, or for loss arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited by law. Where we are liable, our total liability is limited to the amount you paid us in the 12 months before the claim.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or end access if you materially breach these Terms. On termination, your licence to the content ends.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date; material changes will be notified where reasonable. Continued use after changes means you accept them.

15. Governing law

These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction, without affecting any mandatory consumer rights you have where you live.
